General Terms and Conditions of Sale

 

Article 1 – Definitions

These General Terms and Conditions of Sale (hereinafter "GTC") are offered by MA DECO JARDIN, VAT number BE 0795.963.291, registered office at RUE JOSEPH JOSET 60 - 4000 LIEGE, Belgium. The following terms shall be defined as follows: https://www.madecojardin.com and all its pages, exclusive property of the Company.

"Products" or "Services": all products (physical goods) and services that can be purchased or subscribed to on the Site.

"Seller": MA DECO JARDIN, legal or natural person, offering its Products or Services on the Site.

"Customer": the internet user, private individual or professional, making a purchase of Product(s) or Service(s) on the Site.

"Consumer": any natural person acting for purposes outside their commercial, industrial, craft or professional activity, in accordance with the Belgian Code of Economic Law (CEL).

The internet user visiting the Site and interested in the Products and Services offered by the Seller is invited to read these GTC carefully, print them and/or save them on a durable medium, before placing an order on the Site.

The Customer acknowledges having read the GTC and accepts them in full.

Article 2 – Application of the GTC and purpose of the Site

The Seller reserves the right to modify the GTC at any time by publishing a new version on the Site.

The GTC applicable to the Customer are those in force on the day of their order on the Site.

Legal information concerning the host and publisher of the Site, the collection and processing of personal data and the conditions of use of the Site are provided in the general conditions of use, legal notices and data charter of this Site.

This Site offers online sales of outdoor lighting products, including solar lights, LED projectors, wall lights, lanterns and outdoor string lights.

The Site is freely accessible to any Customer. The purchase of a Product or Service requires the Customer's acceptance of all of these GTC. This acceptance may consist of the Customer ticking the box "I acknowledge having read and accepted all the general conditions of the Site", which shall be deemed to have the same value as a handwritten signature.

Acceptance of these GTC requires that Customers have the necessary legal capacity to do so. If the Customer is a minor or does not have such legal capacity, they declare having the authorisation of a guardian or legal representative.

The Customer acknowledges the evidential value of the Seller's automatic recording systems and waives the right to contest them in the event of a dispute.

Any Order for Products implies the Customer's unreserved acceptance and full adherence to these GTC, which take precedence over any other document, unless there is an express prior derogatory agreement from the Company.

Article 3 – Customer Service

The customer service of this Site is accessible by email at: contact@madecojardin.com, by contact form or by post at the address indicated in the legal notices. The Customer must indicate their first name, last name, the subject of their request and their Order number.

For any professional enquiry (partnership, media, contract proposal), the Company can only be reached by email at contact@madecojardin.com.

Article 4 – Order process and description of the purchasing process

The Products and Services offered are those listed in the catalogue published on the Site. Each product is accompanied by a description established by the Seller based on descriptions provided by the supplier.

Photos on the Site are non-contractual and may vary significantly from the photographed models due to screen settings, lighting, angle of the shot, etc.

"Cart" is defined as the immaterial object grouping all Products or Services selected by the Customer for purchase. The Cart contents can be modified at any time.

  1. The Customer places the Order via the Site and validates it.
  2. On the "Cart" page, the Customer can check the details of their Order and correct any errors before confirming it.
  3. On the "Information" page, the Customer must enter their contact details.
  4. On the "Shipping" page, the Customer must choose their shipping method.
  5. On the "Confirmation" page, the Customer must enter their bank details and billing address. A promotional code may be entered if applicable.
  6. A complete Order summary appears. The Customer can modify all Order elements before finalisation.
  7. The sale is validly formed when the Customer has confirmed the Order by clicking "Complete my order", accepted the GTC, and proceeded with payment, subject to the exercise of the right of withdrawal.

The Order validation date corresponds to the date of receipt of full payment of the total price including VAT.

Article 5 – Prices and payment terms

Unless otherwise stated, prices are in Euros inclusive of all taxes (VAT included), excluding any processing and shipping costs.

MA DECO JARDIN reserves the right to pass on any change in the VAT rate to the price of Products or Services and to modify its prices at any time. However, the price listed on the day of the order shall be the only price applicable to the Customer.

The Customer can pay by Credit Card, Bancontact, Apple Pay or PayPal via secure transactions provided by an online payment platform provider. This Site has no access to any data relating to the Customer's payment methods.

MA DECO JARDIN will archive order forms and invoices on a reliable and durable medium. Computerised records will be considered by the parties as proof of communications, orders, payments and transactions.

Article 6 – Deliveries

Delivery costs will be indicated to the Customer before any payment. Orders can be shipped worldwide. Delivery times are for information purposes only and remain dependent on postal service delays or other particular cases preventing delivery (strikes, bad weather, etc.).

In the case of delivery outside the European Union, the Customer declares themselves the importer and accepts that the Seller may be unable to provide exact information on customs duties or import taxes applicable in the destination country.

Unless otherwise stated, the Seller undertakes to deliver Products within a maximum period of thirty (30) days after the conclusion of the contract with a Consumer Customer.

In the case of hand delivery, the Customer may refuse a parcel if they notice an anomaly (damage, missing Product, damaged parcel, etc.); any anomaly must be indicated on the delivery note with handwritten reservations and the Customer's signature. In the case of letterbox delivery, the Customer undertakes to immediately check the parcel and contact MA DECO JARDIN support if they notice any anomaly.

If the Customer's parcel is returned to the Seller, the Seller will contact the Customer to determine the next steps. Reshipment costs are borne by the Customer, even for orders where shipping was originally free.

Any delivery delay exceeding thirty (30) days from the conclusion of the contract may result in the cancellation of the sale at the Consumer Customer's initiative, upon written request by registered letter with acknowledgement of receipt. The Consumer Customer will then be refunded within fourteen (14) days. This clause does not apply in cases of force majeure.

If a parcel's tracking number indicates "delivered" but the Customer has not received it, customer service may request additional information and an official document. The Seller will do everything possible to ensure Customer satisfaction, including immediate reshipment at their own expense.

Article 7 – Right of withdrawal and withdrawal form

In accordance with Directive 2011/83/EU on consumer rights, transposed into Belgian law by the Code of Economic Law (CEL, Book VI), the Consumer Customer has fourteen (14) calendar days from the date of receipt of their order to exercise their right of withdrawal, without having to justify any reason or pay any penalty, except for return costs which remain their responsibility.

The refund will be made within fourteen (14) days of receipt by MA DECO JARDIN of the withdrawal request, subject to receipt of the returned Product or proof of its shipment.

The Product must be returned in perfect condition, in its original packaging and unused. The Customer is advised to use a tracked return method.

The refund will be made using the same payment method as the initial transaction, unless the Customer expressly agrees otherwise, and provided the refund does not incur any costs for the Customer.

The Seller reserves the right to defer the refund until receipt of the Product or proof of shipment. In the event of depreciation resulting from handling beyond what is necessary to establish the nature and characteristics of the Product, the Customer's liability may be engaged.

Article 8 – Product Warranty

In accordance with the Belgian Code of Economic Law (CEL, Book VI) and European Directive 2019/771 on the sale of goods, all items purchased on this Site benefit from the following legal guarantees:

Legal guarantee of conformity

The Seller is obliged to deliver goods conforming to the contract and is liable for any lack of conformity existing at the time of delivery. The legal guarantee of conformity has a duration of two (2) years from delivery.

During the first twelve (12) months following delivery, any lack of conformity is presumed to have existed at the time of delivery, unless proven otherwise. Beyond this period, the Customer must demonstrate that the defect existed at the time of delivery.

In the event of a lack of conformity, the Consumer Customer is entitled first to repair or replacement. If these remedies are impossible or disproportionate, the Customer may request a price reduction or cancellation of the contract.

Legal guarantee against hidden defects

The Customer may also invoke the guarantee against hidden defects in accordance with the Belgian Civil Code, choosing between cancellation of the sale or a price reduction. They have one (1) year from the discovery of the defect to take action.

In the event of non-conformity, the Product may be returned for exchange. If exchange is impossible, the Customer will be refunded by bank transfer. Return costs are borne by the Seller.

Article 9 – Liability

The Seller MA DECO JARDIN cannot be held liable for non-performance due to force majeure. The Seller shall incur no liability for indirect damages, loss of business, loss of profit, or costs that may arise.

The choice and purchase of a Product or Service are placed under the Customer's sole responsibility. The inability to use the Products due to hardware incompatibility cannot give rise to any compensation, except in the case of a proven hidden defect, non-conformity, or exercise of the right of withdrawal.

The Customer expressly acknowledges using the Site at their own risk. MA DECO JARDIN cannot under any circumstances be held liable for:

  • any direct or indirect damage, including loss of profits, loss of earnings, loss of customers or data resulting from the use or inability to use the Site;
  • a malfunction, unavailability of access, misuse or misconfiguration of the Customer's computer or browser;
  • the content of advertisements and other external links accessible from the Site.

Article 10 – Force Majeure

Force majeure events are events beyond the control of the parties, which they could not reasonably foresee or overcome, and which make the performance of obligations totally impossible.

The occurrence of a force majeure event shall automatically suspend the performance of the Order. Beyond ninety (90) calendar days, either party may cancel the Order and terminate the sales contract by registered letter with acknowledgement of receipt. Neither party may claim damages, unless otherwise agreed.

Article 11 – Intellectual Property Rights

All elements of this Site belong to the Seller or are used with the permission of their owners. All texts, illustrations and images reproduced on the Site are protected under copyright, trademark and patent law. No reproduction, exploitation or redistribution is authorised without express written agreement from the Company. Only private use of the Site is authorised.

Article 12 – Personal Data Processing

The Company collects Customer data: (1) to process and track Orders; (2) to contact you about Company events and customer relationship management; (3) to improve the Site and Products through cookies.

Data is processed by contractual service providers and by the hosting provider Shopify Inc., whose servers are secured by a firewall.

Order data is retained for five (5) years in accordance with legal accounting obligations. Marketing data is retained for three (3) years from the Customer's last active contact.

In accordance with GDPR (Regulation EU 2016/679) and the Belgian law of 30 July 2018, the Customer benefits from rights of access, rectification, deletion, portability and objection regarding their data. These rights may be exercised by email at contact@madecojardin.com. In the event of an unresolved complaint, the Customer may lodge a complaint with the Belgian Data Protection Authority (DPA): www.autoriteprotectiondonnees.be.

Article 13 – Comments and other user submissions

By sending comments to the Company, the Customer grants the Company the unrestricted right to edit, copy, publish, distribute and use them in any medium. The Company is not obliged to maintain their confidentiality, pay compensation, or respond to them. The Customer is entirely responsible for their comments and their accuracy.

Article 14 – Severability

If any provision of the GTC is found to be illegal or unenforceable, it shall be deemed severable and shall not affect the validity of the remaining provisions. These GTC replace all prior agreements. All correspondence relating to these GTC must be written in French.

Article 15 – Applicable law and mediation

These General Terms and Conditions of Sale are governed by Belgian law. In the event of a dispute, jurisdiction is attributed to the competent court of Liège (Belgium), without prejudice to the mandatory rights of the consumer to seize the court of their place of residence in accordance with Regulation (EU) No 1215/2012.

Indemnification

You agree to defend, indemnify and hold harmless the Company, its affiliates, officers, directors, agents, service providers, suppliers and employees from any claim or demand, including reasonable legal fees, caused by a third party arising from your use of the website, your violation of these terms or your contractual obligations.

Mediation

Disputes may be submitted to mediation at the Customer's request. The Customer may have free recourse to the Consumer Mediation Service (Belgium):

Mediation is free of charge for the Customer. The fact that a clause becomes null and unenforceable shall not affect the validity of the other provisions.
